Consult PCO if amending the Legislation Act 2019 or the Legislation (Publication) Regulations 2021
This legislation is administered by the PCO, so please consult us on any proposed amendments.
The Legislation Act 2019 (LA2019) is administered by the PCO. So if your Bill amends that Act, the PCO should be consulted in that capacity. It isn’t enough for you just to talk to your drafter.
An amendment may include, for example:
inserting or amending a presentation or disallowance exemption in Schedule 3 of the LA2019
amending Schedule 4 of the LA2019 to provide for secondary legislation to be subject to confirmation.
From time to time, the PCO discusses these schedules with the Regulations Review Committee. So it is important that the PCO maintains oversight over any changes.
For similar reasons, the PCO should be consulted on any proposed amendments to the Legislation (Publication) Regulations 2021 (for example, to create customised publication requirements for secondary legislation).
